Terms & Conditions

Please read these terms and conditions ("Terms") carefully before using the services provided by Pilatisio Physiotherapy (hereinafter referred to as the "Studio"). By booking and participating in our classes, you are indicating your agreement to abide by these Terms. If you do not agree to these Terms, please refrain from using our services.

1. Booking and Payment

1.1 Booking Procedure: To secure your spot in our classes, all participants are required to book in advance using our booking system, available online or in person. We also accommodate walk-in participants if space permits.

1.2 Payment Options: Full payment for classes must be made at the time of booking. We accept payment in the forms of cash, bank transfer, or TnG eWallet exclusively.

1.3 Cancellation and Refunds: We uphold a strict 24-hour cancellation policy. If you need to cancel your booking, kindly do so with at least 24 hours' notice before the scheduled class to be eligible for a refund or credit. To provide further flexibility, you have the option to contact us through WhatsApp to save your credit with an additional charge of RM20 per save. (Please ensure you inform us BEFORE your designated class time and make payment within the same day in order to save your credit.)

2. Studio Policies

2.1 Participant Eligibility: To participate in our activities at Pilatisio Physiotherapy, participants must be 18 years of age or older. For those aged 17 and under, parental or guardian supervision is mandatory.

2.2 Arrival Time: We recommend arriving at the studio 10 to 15 minutes before the scheduled class time. This will allow you to prepare comfortably before the class begins.

2.3 Late Entry and Early Departure: To maintain the safety and respect of all Members, late entry to classes is not permitted. We discourage leaving a class before its completion. Please be aware that the studio doors will be locked 10 minutes after the class commences.

2.4 Purchase Policy: Please note that all purchases of services and products, including classes and memberships, are non-refundable, non-shareable, non-extendable, and non-transferable.

2.5 Payment Back-Charge: Unpaid class or membership fees will be charged back to your designated payment method. We kindly request that you keep your payments up to date to avoid any inconvenience.

2.6 Health and Medical Advice: We advise participants to seek medical advice if they have concerns about their physical condition before engaging in strenuous physical activities. The Studio reserves the right to deny access to any Member if their health might be at risk due to the use of our facilities. It is essential to recognize that the Studio is not responsible for its members' health.

2.7 Health Notifications: Members and their guests are required to inform the Studio of any health-related circumstances that may be affected by continued use of our facilities. This information is crucial to ensure the safety of participants during our classes and activities.

2.8 Prenatal & Postnatal Policy:

  • Prenatal Members:

    • Upon learning of your pregnancy, we kindly request that you inform the Studio. Rest assured, this information will be treated as confidential and shared only with the studio team to provide you with appropriate support.

    • Pregnant members are entitled to use their credits for Prenatal mat yoga. Please be aware that packages for prenatal classes are non-refundable, non-transferable, and non-shareable.

    • As a precaution, we recommend that you refrain from classes until you have consulted your doctor or midwife and received clearance to continue exercising. It is essential to communicate your class preferences to your healthcare provider, who will determine whether participation is safe or if an alternative class is recommended.

    • Ideally, we would appreciate a written note from your doctor or midwife for our records. In cases where written documentation is not available, we will request you to sign a waiver confirming verbal confirmation from your healthcare provider.

  • Postnatal Members:

    • After giving birth, we recommend waiting for at least 6 weeks postpartum before returning to our regular classes at the Studio. For members with specific medical conditions or complications, it may be necessary to wait longer. We advise consulting a healthcare professional for guidance.

    • In the case of a caesarean section, we recommend waiting for at least 12-13 weeks postpartum to ensure proper healing. Please note that we require approval from your doctor or midwife before rejoining our regular classes.


3. Personal Belongings and Membership Conduct

3.1 Safekeeping of Personal Belongings: The Studio does not assume responsibility for safeguarding members' personal belongings. We encourage you to exercise caution and take measures to secure your valuables while visiting our studio.

3.2 Membership Conduct: The Studio reserves the right to withdraw, suspend, or refuse to renew the membership of any Member whose conduct is, or may be deemed by the Studio's reasonable discretion, detrimental to the studio's character or constitutes a breach of the Terms & Conditions, or is otherwise in the best interests of other Studio members. Members who are expelled will forfeit all membership privileges and will not be eligible for refunds during the suspension period.


4. Intellectual Property

All content, including but not limited to logos, images, and instructional materials, provided by Pilatisio Physiotherapy is protected by copyright and may not be used or reproduced without express permission.


5. Privacy Policy

We value your privacy and will handle your personal information in compliance with our Privacy Policy.


6. Amendments and Termination

Pilatisio Physiotherapy retains the right to modify or terminate these Terms at any time. Any amendments will become effective immediately upon posting on our website or providing notification to you.

8. Acknowledgment of Risks and Release of Liability

8.1 Acknowledgment of Inherent Risks:

  • I hereby confirm my full understanding of the possibility of inherent risks, dangers, and hazards associated with the activities and/or use of the equipment within the Premise.

8.2 Physical Examination and Permission:

  • I further acknowledge that it is my responsibility to undergo a physical examination and obtain my physician's approval before participating in the activities and/or using the equipment.

8.3 Assumption of Risk:

  • I hereby assume all risks of injury, illness, death, damage, or loss to myself or my property that may occur while using the Premise, the Equipment, or participating in the Activities. These risks may arise from active or passive acts of negligence, action or inaction, on the part of the Company or the Associates.

8.4 Equipment Liability:

  • I understand and acknowledge that the Company procures equipment from third parties and is not involved in the manufacturing or assembly of any equipment used on the premises. Consequently, I agree that the Company shall not be held liable for defects in products or equipment, nor any injuries, losses, or damages arising from such defects.

8.5 Personal Property Responsibility:

  • I accept personal responsibility for any damage, loss, or theft of my personal property while on or near the Studio's facilities, including the contents of any locker I may use.

8.6 Release and Indemnification:

  • I, the undersigned, on my own behalf and on behalf of my next of kin, heirs, personal representatives, and assigns, hereby release, indemnify, and hold harmless the Company and the Associates from any and all claims, demands, damages, rights of action, or causes of action, whether present or future. These claims may arise from my participation in any Activities within the Premise, usage of the Equipment and/or the Premise, and any injuries that may result, including those arising from the negligence of the Associates or other factors, to the fullest extent allowed by law.


9. General Provisions

9.1 Headings: The headings in these terms and conditions are for convenience only and do not affect their interpretation.

9.2 Statutory References: Any references in these terms and conditions to specific statutory provisions shall be interpreted as references to those provisions as amended, re-enacted, or extended at the relevant time.

9.3 Governing Law and Jurisdiction: These Terms and Conditions are governed by the laws of Malaysia and are subject to exclusive jurisdiction within Malaysia.
